The relationship between the Federal and the State Governments, so firmly established in the Federal Constitution, is vital for Malaysia to progress as a strong, stable and united Federation. It is therefore very important for Malaysians to understand and appreciate the distribution of sovereign powers between the Federation and the 13 constituent States.
This book is published 45 years after the formation of Malaysia at a time when it is so vital to carefully reflect on how this nation is moulded by the many historical events and challenges (both internal and external) that preceded its birth, and by a Constitution so carefully and skillfully crafted to provide for the emergence of a strong, stable and functional Federal system of Government best suited for a multi-racial society.
This book covers constitutional history and discusses the Federal system of Government under the Constitution, involving, inter alia, the distribution of Legislative and Executive powers, the rights and responsibilities of the Federal and the State Governments, the sharing of revenues and financial burdens and functions between the Federal Government and the States, the special protections for Sabah and Sarawak, and amendments to the Federal Constitution, particularly those amendments which could affect the rights and interests of the States. An extensive discussion of the powers of Parliament to amend the supreme law and guiding principles of the Constitution is given.
This book also discusses the relevancy of the 20 points “agreement” or manifesto presented to the Inter Governmental Committee by the Sabah delegation in the light of the Malaysia Agreement, and, the importance of consultation provided for in certain pertinent Articles of the Federal Constitution and the need to develop a proper mechanism for meaningful consultative process to take place whenever stipulated by the provisions of the Constitution.
This book would be of interest to political leaders and administrators involved in the management of Federal-State relationships, judicial officers, legal practitioners, politicians as well as teachers and students of law and constitutional history.
